At Fateh Excellence Preschool & Daycare, we respect the sacred trust parents place in us when enrolling their children. Protecting the personal data of young children and their families is a foundational institutional responsibility.
This Privacy Policy sets out our commitments and operational practices as a Data Fiduciary under India's Digital Personal Data Protection Act, 2023 (Act No. 22 of 2023) and applicable rules thereunder. It explains in transparent, plain language what data we collect, why we need it, how we safeguard it, and how parents or lawful guardians can exercise their legal rights over personal data.

- Personal data in digital format or personal data collected in non-digital form that is subsequently digitized.

- Date of Birth and Age Verification (Birth Certificate copy)

- Student Aadhaar Card (where issued)
- Recent passport-size photographs (4 copies requested at enrolment)
- Class / Program of enrollment (Playgroup, Nursery, JR.KG, SR.KG, Daycare)
C. Health, Safety & Care Information
- Allergies, chronic conditions, or dietary restrictions voluntarily shared by parents to ensure child safety
- Pediatrician name and emergency clinic contact
- Special developmental or emotional care instructions
- Immunization / Vaccination records required for daycare and group classroom health
D. Website & Technical Information
- Basic server logs: IP address, browser type, timestamp (used solely for cyber defense, fraud prevention, and rate limiting)
- Form submission timestamps
- NO third-party advertising or commercial tracking cookies are deployed on our website.
Specified Purposes of Processing
Under Section 4 and Section 6 of the DPDP Act, personal data may only be processed for specific, lawful purposes for which consent has been obtained:
Lawful Basis for Processing
Under the DPDP Act, 2023, our processing rests upon:
- Verifiable Parental Consent (Section 6 & Section 9): Obtained via affirmative checkbox on website forms and written admission declaration forms signed by the parent or legal guardian.
- Certain Legitimate Uses (Section 7): Processing strictly necessary for responding to a medical emergency involving a child's health or life, compliance with any judgment, decree, or order issued under Indian law, or responding to epidemics/public safety directives.
Processing of Children's Data (DPDP Act Section 9 Aligned)
Mandatory Protections for Young Learners under Indian Law:
- verified_userVerifiable Parental Consent: As all students at Fateh Excellence Preschool & Daycare are below 18 years of age (typically aged 1.5 to 6 years), no child's personal data is ever collected or processed without verifiable consent from their parent or lawful guardian.
- blockAbsolute Prohibition of Tracking & Profiling: Under Section 9(2) of the DPDP Act, the school does NOT undertake any tracking, behavioral monitoring, or profiling of children.
- campaignNo Targeted Advertising: Under Section 9(3) of the DPDP Act, we never serve targeted advertisements directed at children, nor do we disclose child data to commercial ad networks.
- favoriteChild Well-Being Safeguard: Under Section 9(1) of the DPDP Act, no processing shall be undertaken that is likely to cause any detrimental effect on the physical, emotional, psychological, or educational well-being of the child.
Consent Mechanism & Right to Withdraw Consent
Consent is obtained through an un-checked, affirmative checkbox on all digital forms with clear link to this policy, and physical signed forms at admission.
Withdrawal is as easy as giving consent: Under Section 6(4) of the DPDP Act, parents and legal guardians have the right to withdraw their consent at any time without penalty for past lawful processing.
How to withdraw consent:
Send an email from your registered email address to fatehexcellence.edu@gmail.com with the subject "Withdrawal of Data Consent - [Child's Name]", or submit a written request at the school office desk.
Note: If consent is withdrawn for core student identification records, the school may be unable to continue providing preschool or daycare enrollment services due to regulatory requirements.
Rights of Parents / Legal Guardians (Data Principals)
Under Chapter III of the DPDP Act, parents or legal guardians acting on behalf of their child are entitled to the following enforceable statutory rights:
Right to Access Information
You may request a summary of the personal data of your child and yourself being processed, as well as the identities of any authorized service providers with whom it has been shared.
Right to Correction & Completion
You can request immediate correction of inaccurate data, updating of changed contact numbers or addresses, and completion of incomplete records.
Right to Erasure
You may request erasure of personal data that is no longer necessary for the admission or care purpose, or when you have withdrawn consent, unless retention is mandated by law.
Right to Nominate
Under Section 14 of the DPDP Act, you have the right to nominate another individual who shall exercise data principal rights in the unfortunate event of your death or incapacity.
Data Retention & Secure Erasure Schedule
Under Section 8(7) of the DPDP Act, personal data must be erased once the purpose of collection has been served or consent is withdrawn:

Technical & Organisational Security Safeguards
Under Section 8(5) of the DPDP Act, we maintain reasonable technical and organizational safeguards:
- Data Encryption: All data transmitted to and from our website is encrypted using industry-standard TLS/SSL encryption (HTTPS). Databases are encrypted at rest with AES-256 standards.
- Role-Based Access Control: Access to student records and parent contact lists is restricted strictly to designated teachers and administrators with authenticated credentials.
- Physical Security on Campus: Student physical files are kept in locked administrative cabinets at the Kalamboli campus. 24/7 CCTV surveillance protects premises and children.
- Staff Confidentiality Undertakings: All teaching and care staff sign child safety and data confidentiality agreements upon joining.
Personal Data Breach Notification
In the improbable event of a personal data breach affecting digital or physical records, Fateh Excellence Preschool & Daycare shall, in accordance with Section 8(6) of the DPDP Act:
- Notify the Data Protection Board of India (DPBI) in the form and manner prescribed under the Act.
- Notify each affected parent or legal guardian promptly via registered phone/email, detailing the nature of the breach, affected records, risks, and recommended actions or remediation steps implemented by the school.
Storage & Cross-Border Data Processing
Our primary student management and operational records are stored on secure servers located within India or hosted by globally certified infrastructure providers adhering to Indian data protection safeguards.
In compliance with Section 16 of the DPDP Act, personal data is never transferred to any country or territory restricted or blacklisted by the Central Government of India.
Grievance Redressal & Right to Approach DPBI
In compliance with Section 8(9) and Section 13 of the DPDP Act, 2023, the school has designated a dedicated Grievance Officer:

Response Timelines: Every grievance is acknowledged within 48 hours and resolved within 30 calendar days.
Statutory Right to Approach the Data Protection Board: If a parent or legal guardian is not satisfied with the grievance resolution provided by the school, or has not received a response within the prescribed timeline, they have the statutory right under Section 13(4) of the Act to file a complaint before the Data Protection Board of India (DPBI).

We may update this policy periodically to reflect statutory updates, school policy developments, or guidelines issued by the Data Protection Board of India. Any material updates will be prominently announced on our website and notified to enrolled parents.
